Terms and Conditions for Bespoke Products

These Terms and Conditions (“Terms”) apply to all purchases of bespoke or personalised products made through Ashtree Marine Limited (“we”, “us”, “our”), whether via our website, by email, or any other remote method.

By placing an order with us, you agree to be bound by these Terms.


1. Bespoke Products

1.1. All products we supply are made to order and tailored to your specifications.

1.2. It is your responsibility to ensure that all design specifications, measurements, and personalisation details are accurate at the time of ordering.


2. Pricing and Payment

2.1. All prices are quoted in GBP (£) and include VAT where applicable.

2.2. We require full payment (or a specified deposit) before commencing production unless otherwise agreed in writing.

2.3. Payment can be made by online payment via Stripe on the website. We can also take payment via BACs transfer and Paypal; account details are available on request; contact support@ashtree-marine.com


3. Order Confirmation and Production

3.1. Your order is only confirmed once we issue a written confirmation (via email or otherwise).

3.2. Production times vary depending on the product and will be outlined in your confirmation.

3.3. We reserve the right to reject any order at our discretion, in which case any payment made will be refunded in full.


4. Delivery

4.1. Delivery times are estimated and not guaranteed unless explicitly agreed.

4.2. Risk in the goods passes to you upon delivery.

4.3. You must inspect the goods upon delivery and notify us within 48 hours if any damage has occurred during transit.


5. Cancellations and Returns

5.1. Under the Consumer Contracts Regulations 2013, you do not have a statutory right to cancel an order for custom-made or personalised goods once production has begun.

5.2. No cancellations, refunds, or changes can be accepted once your order has entered production, except in the case of faulty or non-conforming goods (see Section 6).


6. Faulty or Non-Conforming Goods

6.1. If your product is faulty or not as described, you have rights under the Consumer Rights Act 2015.

6.2. You must report any fault to us within 30 days of receipt and provide reasonable evidence (e.g. photos or return of the item).

6.3. We will offer a repair, replacement, or refund, depending on the circumstances.

6.4. If the product is found not to be faulty or the issue is due to misuse, we reserve the right to charge for return costs or repairs.


7. Intellectual Property

7.1. All designs, images, and content on our website or provided by us remain the intellectual property of Ashtree Marine Limited.

7.2. You may not reproduce, copy, or distribute our content or products for commercial purposes without permission.


8. Liability

8.1. We are not liable for indirect, incidental, or consequential loss or damage arising out of or related to your use of our products.

8.2. Our total liability shall not exceed the amount paid by you for the product.


9. Governing Law

9.1. These Terms are governed by the laws of England and Wales.

9.2. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
